Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Pluck mobile application ("Pluck", "the app") and the related website at this domain (the "Site"). Pluck is provided by Kode Foundry ([LEGAL_ENTITY_DETAILS]), referred to as "we", "us", or "our". By downloading, installing, or using Pluck, you agree to these Terms. If you do not agree, do not use the app.

If you are using Pluck on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Pluck on iOS devices that you own or control, solely for your personal or internal business purposes.

This license does not grant you any right to:

• Copy, modify, translate, or create derivative works of Pluck;
• Reverse-engineer, decompile, or disassemble the app, except to the extent that such restriction is prohibited by applicable law;
• Remove, alter, or obscure any proprietary notices in the app;
• Resell, redistribute, sublicense, or otherwise commercialize Pluck;
• Use Pluck to build a competing product.

All rights not expressly granted are reserved by us.

3. Acceptable use

You agree to use Pluck only for lawful purposes and in compliance with all applicable laws, including data-protection laws of the jurisdictions where the contacts you process are located. You are responsible for ensuring you have the right to read, export, modify, or share contact information using Pluck.

You agree not to:

• Use Pluck to harvest, sell, or distribute contact information without lawful basis or consent;
• Use Pluck to facilitate unsolicited bulk messaging, spam, or fraud;
• Bypass technical measures, abuse iOS permissions, or interfere with the integrity of the app;
• Use Pluck in any way that could damage, disable, or impair the app or another user's device.

4. Your data

Pluck processes your contact data on your device. We do not have a back-end and do not collect or store your contact data. See the Privacy Policy for full details. You retain all rights to your data; we claim no ownership over the contacts you load, the files you export, or any backups you create.

You are responsible for backups. The Backup & Restore and Clean Up features can write to or delete from your iOS address book when you confirm an action. We strongly recommend keeping an independent backup (for example, an iCloud Contacts sync or a .vcf export stored elsewhere) before performing destructive operations.

5. Intellectual property

Pluck, including its name, logo, source code, designs, and content of the Site, is owned by Kode Foundry and protected by copyright, trademark, and other laws. Nothing in these Terms transfers any of these rights to you, except for the limited license granted in Section 2.

6. Third-party terms

Pluck is distributed via the Apple App Store and is therefore subject to Apple's Media Services Terms and the App Store Standard EULA between you and Apple. To the extent any conflict exists between these Terms and Apple's Standard EULA, Apple's terms govern that conflict for your use through the App Store. You acknowledge that:

• These Terms are between you and us, not Apple. We (not Apple) are solely responsible for Pluck.
• Apple has no obligation to provide maintenance or support for Pluck.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

7. Updates & availability

We may release updates to Pluck that fix bugs, change features, or add new ones. Some updates may be required for continued use, and your iOS device's settings determine whether updates install automatically. We do not guarantee that any particular feature will be available indefinitely.

We may suspend or discontinue Pluck (in whole or in part) at any time, with or without notice. Because Pluck is a local app and we do not hold your data, discontinuation does not result in loss of your contacts or previously exported files.

8. Disclaimer of warranties

Pluck is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that exports will be complete, that backups will succeed for every record, or that Pluck will be compatible with every present or future iOS version.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the fullest extent permitted.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall Kode Foundry, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or contact records, arising out of or in connection with your use of, or inability to use, Pluck, even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to these Terms or your use of Pluck shall not exceed the greater of (a) the amount you paid us for Pluck in the twelve months preceding the claim, or (b) ten US dollars (USD $10).

10. Indemnification

You agree to defend, indemnify, and hold harmless Kode Foundry, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (i) your violation of these Terms; (ii) your use of Pluck in violation of applicable law; or (iii) your processing of contact data without the necessary rights or consents.

11. Termination

You may stop using Pluck at any time by deleting the app from your device. We may terminate or suspend your license under these Terms if you breach them. On termination, the rights granted in Section 2 end; Sections 4, 5, and 8–13 survive.

12. Governing law

These Terms are governed by the laws of [GOVERNING_JURISDICTION], without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in [GOVERNING_JURISDICTION], except that we may seek injunctive relief in any competent court to protect our intellectual property.

If you are a consumer in the European Union or United Kingdom, mandatory consumer-protection laws of your country of residence still apply regardless of the choice of law above.

13. Changes to these terms

We may update these Terms from time to time. If a change is material, we will update the Effective date above and, when practical, notify users in-app or on the Site before it takes effect. Continued use of Pluck after the effective date constitutes acceptance of the revised Terms.
